Ben Cheesbro is an associate at Caplan Cobb specializing in complex business litigation, technology and privacy law, and appellate practice.  Before joining Caplan Cobb, Ben practiced at Troutman Sanders LLP in Atlanta.

Before entering private practice, Ben served as the Common Law Lecturer at the Johannes Gutenberg University School of Law in Mainz, Germany, where he lectured on the American legal system, common law principles, and intellectual property law.  Ben also coached the University’s various moot court teams.  Following his lectureship, Ben served as a law clerk to the Honorable Lisa Godbey Wood, Chief Judge of the United States District Court for the Southern District of Georgia.

Before becoming a lawyer, Ben served on active duty in the United States Army as a member of the 101st Airborne Division and served several years with the Louisiana National Guard.  He was deployed in support of Operation Iraqi Freedom and served during Hurricane Katrina relief operations in New Orleans.

PRACTICE AREAS

Business Litigation & Counseling.  Ben has extensive experience representing both plaintiffs and defendants in a wide range of business disputes.  Ben has represented large publicly traded companies, non-profits, as well as individuals in suits against large companies.  Ben has represented parties in commercial landlord-tenant disputes, loan and guarantee cases, and contract disputes between retailers and suppliers.  Ben also has experience with environmental contamination and remediation disputes and environmental toxic tort cases.  Ben has represented public utilities and government entities in numerous real property disputes and condemnation actions.  Ben has represented parties in several actions in state and federal trial courts, as well as in JAMS and AAA arbitrations.

Technology and Privacy Law.  Ben also specializes in technology and privacy law.  Ben has represented and advised clients in data-breach cases, and has counseled clients on information management issues, including compliance with state and federal data privacy laws, hosted services, software, and entering into contracts for technology-related services.  Ben also has expertise in managing electronically stored information in the course of electronic discovery.

Appellate Practice.  Ben has represented parties in appeals to the Eleventh Circuit Court of Appeals, the Georgia Supreme Court, and the Georgia Court of Appeals.  Ben has worked on appeals addressing several challenging issues, such as the sufficiency of expert witness testimony on lost profits, common law tort claims for a data breach, and the effect of real property tax deed sales.  Ben regularly assists the University of Georgia School of Law Appellate Practice Clinic and Moot Court program with preparing for appellate oral arguments.
