Erin Morrissey Victoria is counsel at Caplan Cobb, where her commercial litigation practice encompasses a wide range of substantive areas, including media law, healthcare law, and general commercial disputes. Erin’s ability to navigate complex legal landscapes and her skill in handling all stages of litigation have earned her a reputation as a highly effective litigator.

Before joining Caplan Cobb, Erin practiced at BakerHostetler LLP in Atlanta, helping secure favorable resolutions in state and federal cases on behalf of clients including a major pharmaceutical company, a non-profit hospital system, and nationwide and local media outlets and reporters.  

Erin earned her J.D., summa cum laude, from Tulane University, where she was valedictorian of her class and served as Managing Editor of the Tulane Law Review. She also holds a Master of Arts in Latin American Studies from Tulane University and a B.A. in Spanish from the University of Kansas.

Erin is fluent in Spanish and English, and regularly counsels clients in both languages. Prior to attending law school, Erin lived and worked abroad in Europe and Latin America, gaining extensive experience in professional and legal translation.

Erin has successfully resolved business disputes in state and federal court and private arbitration on behalf of clients of all sizes. She advises both start-up and institutional clients on complex legal issues impacting their business operations. Efficient yet thorough, she works to understand her clients’ businesses and their goals so that she can focus on the outcomes that matter for them.

Media Law

Erin provides prepublication review services in both English and Spanish for local news companies, nationally syndicated television programs, podcasters, and print media. She provides realistic advice that maintains the integrity of her clients’ stories while minimizing legal risk. Erin also has extensive experience securing documents and information from state agencies under Georgia’s Open Records Act and has helped numerous media clients obtain documentation central to their reporting. She has also helped media clients gain and maintain access to public proceedings, including a high-profile Georgia criminal trial. Erin has also defended media clients in state and federal defamation litigation, including working with the University of Georgia First Amendment Clinic to secure summary judgment in federal court on behalf of content-creator client based on the limited-purpose-public-figure and actual-malice doctrines.

Healthcare Law

Erin helps healthcare clients confront the complex challenges and strategic considerations unique to their field. She has secured favorable settlements for nonprofit hospital systems in contract disputes with managed care payors. She has successfully navigated physician employment issues, restrictive covenants, and the peer review process on behalf of hospitals, physicians, and private practices. Having represented a range of individuals and entities in the healthcare space, Erin has a nuanced understanding of what is at stake for each client.
