Caplan Cobb’s Mike Caplan represents Justin Chapman, who was convicted of felony murder and arson in 2007.
After a three-day evidentiary hearing on Mr. Chapman’s habeas petition on December 3-5, the Superior Court of Telfair County today granted Mr. Chapman relief. The Court determined that the state failed to disclose exculpatory evidence as required by Brady v. Maryland, violated Mr. Chapman’s right of cross- examination as protected by the Fifth Amendment, and denied Mr. Chapman effective assistance of counsel as guaranteed by the Sixth Amendment. Mr. Chapman, who has served 8 years in prison for a crime he did not commit, will be released from his incarceration unless the state appeals.
