Last week, the Fulton County Superior Court granted summary judgment to Georgia’s capital defense bar—represented by Caplan Cobb and Bondurant Mixson & Elmore—in their suit to enforce their 2021 contract with the Georgia Attorney General’s office about the conditions under which executions could resume following the COVID-19 pandemic. The trial court has permanently enjoined the State from executing nine death-row prisoners until the contract conditions are met, including that COVID vaccines are available to everyone of all ages.

The court also found that the State breached the contract when it attempted to execute a prisoner before the contract conditions were met and without the contractually required notice. We secured a preliminary injunction to stop that execution in 2022 and now have a final ruling that the State’s actions were wrong.
